JR – No one. It changes nothing, and that is the problem. As long as there is intense competition, the banks will continue to run the title and escrow show.

So my experience has been that if the buyer uses the seller’s title company then the bank/reo will pay transfer taxes or title insurance. The buyer has the right to use their own settlement or title company and if they make that election then the bank/reo will not pay the incentives. It is already in their addendum as an incentive.

You are right about this new law.If the bank has a choice who they sell the property to they will work with the person who will make the transaction easiest and most likely to close.I think the banks choose a title comapny they are comfortable with.Beleive it or not there are some real piss poor title companies out there.
